Транскордонне співробітництво України з країнами ЄС: правове регулювання геополітичного пріоритету

Abstract

Розглянуте правове регулювання транскордонного співробітництва України з країнами Європейського Союзу в контексті легітимації ЄС як основного геополітичного вектору української зовнішньої політики. Зроблені висновки про те, що основну правову основу з транскордонного співробітництва поміж Україною та ЄС складають міжнародно-правові акти, національне законодавство, двосторонні угоди різного змісту. Розвиток законодавства з транскордонного співробітництво пройшов основні три етапи: 1) встановлення основного термінологічного-понятійного апарату, визначення напрямків, прав та обов’язків сторін транскордонних відносин (1994-2015); 2) легітимація пріоритетів регіональної політики (2015-2019); 3) внесення конституційних змін щодо визначення ЄС в якості геополітичного пріоритету, конкретизація нормативно-правових норм із укладення та реєстрації угод щодо транскордонного співробітництва (2019-дотепер).

With Ukrainian receiving the candidate status for joining the EU in the conditions of a large-scale Russian military invasion, the integration processes with the EU countries were intensified. One of the main directions of the intensification of relations has become the spread and legitimization of ties with border countries. The EU has become not only a historical partner, but also a constitutionally defined foreign policy priority.Despite the existence of the works of modern researchers on cross-border cooperation, its legal regulation, the analysis of the dynamics of the development of national legislation and the legislation of the European Union through the prism of the formation of geopolitical priorities is insufficiently studied and highlighted.The purpose of the study is to analyze the legal regulation of Ukraine’s cross-border cooperation with the countries of the European Union in the context of EU legitimation as the main geopolitical vector of Ukrainian foreign policy. The subject of the research is the legal framework of the EU and Ukraine regarding cross-border cooperation, its historical development and current state. The main research methods were historical and comparative. As a result of the research, the conclusions were made that the main legal basis for cross-border cooperation between Ukraine and the EU is international legal acts, national legislation, bilateral agreements of various contents. The development of legislation on cross-border cooperation went through three main stages: 1) еstablishment of the main terminological and conceptual apparatus, definition of directions, rights and obligations of parties to cross-border relations (1994-2015); 2) legitimation of regional policy priorities (2015-2019); 3) introduction of constitutional changes regarding the definition of the EU as a geopolitical priority, specification of legal norms on the conclusion and registration of agreements on cross-border cooperation (2019-until now).
